By accessing or using the BST Rehoming portal at rehoming.birdsittingtoronto.ca ("the Platform"), operated by Bird Sitting Toronto ("BST," "we," "our," or "us"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, please do not use the Platform. We reserve the right to update or modify these Terms at any time, and your continued use of the Platform constitutes acceptance of any changes.
To use the BST Rehoming portal, you must be at least 18 years of age and legally capable of entering into binding agreements under the laws of Ontario, Canada. By submitting an application, waitlist registration, or rehome request, you represent that you meet these eligibility requirements and that all information you provide is truthful and accurate.
When you submit information through the Platform, including applications, waitlist registrations, and rehome requests, you are responsible for ensuring the accuracy and completeness of all information provided. You agree not to impersonate another person, submit false or misleading information, or use the Platform for any unlawful purpose. BST reserves the right to reject, suspend, or remove any submission that violates these Terms or that we reasonably believe to be fraudulent or harmful.
The BST Rehoming adoption process consists of the following steps:
If you submit a request to rehome your bird through the Platform, you represent that you are the legal owner of the bird or have authorization from the owner to arrange rehoming. You agree to provide accurate information about the bird's health, temperament, care requirements, and history. BST reserves the right to decline any rehome request at our discretion. Once your bird is listed and an adopter is selected, you agree to cooperate in good faith to facilitate a smooth transition.
By uploading photos, submitting application responses, or providing any other content through the Platform, you grant BST a non-exclusive, royalty-free, worldwide license to use, display, reproduce, and distribute that content in connection with operating and promoting the Platform and our rehoming services. This includes but is not limited to:
You retain ownership of any original content you submit, but you acknowledge that BST may retain copies of your submissions for record-keeping and platform improvement purposes.
The Platform uses artificial intelligence to assist in evaluating adoption applications through chat interviews and scoring. You acknowledge that AI-generated scores and recommendations are advisory tools used to assist BST administrators and do not constitute final decisions. All final adoption decisions are made by BST staff. BST is not responsible for any errors, biases, or limitations in the AI system's assessments.
BST Rehoming provides the Platform on an "as is" and "as available" basis. To the fullest extent permitted by law, BST disclaims all warranties, express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, and non-infringement. BST shall not be liable for any direct, indirect, incidental, special, consequential, or punitive damages arising out of or related to your use of the Platform, including but not limited to:
You acknowledge that adopting or rehoming a bird involves inherent risks and that BST acts solely as a facilitator connecting birds with potential adopters. BST does not guarantee the health, temperament, or behavior of any bird listed on the Platform.
When using the Platform, you agree not to:
Your use of the Platform is also governed by our Privacy Policy, which describes how we collect, use, store, and protect your personal information. By using the Platform, you consent to the practices described in our Privacy Policy.
These Terms shall be governed by and construed in accordance with the laws of the Province of Ontario and the federal laws of Canada applicable therein, without regard to conflict of law principles. Any disputes arising from or relating to these Terms or your use of the Platform shall be subject to the exclusive jurisdiction of the courts of the Province of Ontario, Canada.
BST reserves the right to terminate or restrict your access to the Platform at any time, without notice, for any reason, including but not limited to violation of these Terms. Upon termination, your right to use the Platform ceases immediately. Provisions of these Terms that by their nature should survive termination shall remain in effect.
